Terms of Service

These terms are the agreement between you and Azurite Solutions LLC, an Arizona limited liability company ("we", "us"), covering the Starfire game, the starfiremud.com website, and everything we provide through them (the "Service").

By creating an account or playing, you accept these terms. If you do not accept them, do not use the Service.

1. Who may use Starfire

You must be at least 13 years old. If you are under 18, you may only use the Service with the consent of a parent or guardian, who accepts these terms on your behalf and is responsible for any purchases you make.

You may not use the Service if we have previously closed your account for cause.

2. Your account

You are responsible for what happens on your account, including keeping your password secret. One person, one account, and accounts are not shared or transferred. Tell us promptly at support@starfiremud.com if you believe someone else has access to yours.

We may require you to verify your email address before you can create a character or enter the world.

3. Rules of Conduct

The Rules of Conduct form part of these terms. Breaking them may result in warnings, suspension, or permanent closure of your account.

4. What you get, and what you do not own

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own entertainment. That is all that is granted.

Characters, items, currency, credits and any other in-game content are not your property. They are features of a licence to use our software. They have no cash value, they cannot be redeemed for money, and they cannot be sold or transferred outside the Service. We may change, rebalance, or remove any of them as part of running and developing the game.

The Service, its code, artwork, text and the Starfire name are owned by us or our licensors and are protected by copyright and other laws. Third-party components are acknowledged in the software's accompanying notices.

6. Purchases and credits

Some features are sold for real money. Purchases are handled by our payment provider, who acts as the merchant of record: your contract of sale for a purchase is with them, and their terms apply to the transaction alongside these.

Credits purchased are a limited licence to access in-game features. They are not money, they are not a deposit, they carry no interest, and they cannot be exchanged for cash. Prices and the contents of the store may change at any time.

Refunds are covered by the Refund Policy.

7. Content you submit

Anything you type into the Service - chat, character names and descriptions, support tickets - remains yours, but you grant us a worldwide, royalty-free licence to store, display and transmit it so we can run the game, moderate it, and provide support.

Do not submit anything you do not have the right to submit. We may remove content that breaks these terms or the Rules of Conduct.

8. Availability

Starfire is provided as it is. We do not promise uninterrupted availability: we restart the server, deploy updates, fix things, and occasionally break things. We may change or discontinue features, worlds, or the Service itself.

If we discontinue the Service entirely, we will give reasonable notice and stop selling credits before we do.

9. Suspension and closure

We may suspend or close an account that breaks these terms or the Rules of Conduct, or where we reasonably believe it is necessary to protect other players or the Service. Except in serious cases we will tell you why, and you may appeal to support@starfiremud.com.

You may close your own account at any time from your account page. Doing so deletes your characters and any unused credits, and it cannot be undone.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these terms limits rights you have under mandatory consumer law.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, characters or in-game items.

Our total liability arising out of the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the Service, except to the extent the claim results from our own wrongdoing.

13. Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules, and the courts of Maricopa County, Arizona have jurisdiction.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions of your country of residence, or of your right to bring proceedings there.

14. Changes to these terms

We may update these terms. Material changes will be announced in game and on the news page before they take effect. Continuing to use the Service after that means you accept the new version; if you do not, close your account.

15. General

If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. These terms, the Rules of Conduct, the Privacy Policy, the Cookie Policy and the Refund Policy are the whole agreement between us about the Service.
